What is an easement?  Well, an easement is a particular right to use someone else's property without actually owning it.  It is the "right of way" of one land owner over another one.

Easements help provide pathways across two or more pieces of property.  Or the rights to use someone else's property for your own purposes such as:  fishing in a privately owned lake or pond, the use of a dirt fire road that cuts through two different properties (your property and your neighbors property), or perhaps your neighbor has to drive through your property to get to his.

It is very important that you research the easements before you buy any undeveloped land.  The easement is the legal right to use another person's land for a specific purpose.  Therefore, an easement can drastically affect the development and use of your property.  

So if you have to drive through your neighbors land to get to yours, that means that your house must be built ten to fifteen feet away from the access road and if the road cuts through the middle of the lot it might create a space problem for you.  This may mean that you will have a hard time finding the room to build the house you want to build.  Therefore, you should spend significant time researching the easements before you make any buying or building decisions of any kind.

Your best bet is to consult with your realtor about easements.  Your realtor will be more than happy to refer you to a qualified attorney or title researcher so that you can obtain accurate information about the easements for the particular property you are interested in.

If you choose to make an offer on some undeveloped land that could potentially have an easement issue, make sure that you include a contingency in your contract that clearly states that you have the option to approve any existing easements; otherwise, the contract is null and void.
